Legal age for sex tipped to rise to 20

The legal age at which a woman can be taken as a sex partner will increase from 15 to 20 under a new proposal, as the government seeks new ways to prevent unwanted pregnancies.

The Social Development and Human Security Ministry has proposed an amendment to Section 277 of the criminal law which states that a man who has sex with a girl aged 15 or under shall be fined between 8,000 baht and 40,000 baht, and imprisoned from four to 20 years.

"The girl's age should be more than15 because girls aged 15 to 20 have not yet reached maturity," minister Issara Somchai said yesterday.

"The change may upset some groups, but the law is designed to punish the wrongdoer. If you observe the law, there's no reason to be afraid. Our society always blames the girl, which is wrong."

The recent discovery of 2,002 aborted foetuses at Wat Phai Ngern Chotanaram in Bang Kholaem district of Bangkok has drawn attention to unwanted pregnancies. The foetuses, the result of illegal abortions, were transported to the temple from underground clinics.

The minister said five groups of women were particularly at risk of unwanted pregnancies: primary and lower secondary school students, women who live in slum communities, who live in dormitories, young factory workers and the homeless.

Cabinet on Tuesday approved six strategies for tackling the problem, including more assistance and rehabilitation for pregnant women.

Mr Issara said the strategies would be piloted in Kamphaeng Phet, which has the highest number of young mothers aged under 20.

Wit Jirapaet, of the Attorney-General's Office, said Thais should debate the need for sex education and greater access to birth control.

A legal team has also proposed a punishment under law for men who refuse to take responsibility if they make their partners pregnant.

This step might encourage more men to use birth control, he said.

That's according to the Bangkok Post. Not that I'm in favor of sex with minors but it seems like if your current age is 15 you might want to try the age the rest of the world seems to find appropriate, 18, rather than jumping all the way to 20.

The parts about punishment for men who refuse to take responsibility but the rest seems more or less wishful thinking. If they make it law, people will suddenly quit doing it. Like drugs, booze, and all other vices people aren't going to stop just because the law says it's illegal.

The age of consent in Spain is 13, as specified by the Spanish Penal Code, Article 181(2). However, if deceit is used in gaining the consent of a minor under 16 years an individual can be charged under Article 183(1) upon parental complaint.

"181(1) El que, interviniendo engaño, cometiere abuso sexual con persona mayor de trece años y menor de dieciséis, será castigado con la pena de prisión de uno a dos años, o multa de doce a veinticuatro meses.

This one is aimed more at Thais than us farang. And if you've spent any amount of time here I'm sure you've met at least a few 18 or 19 year old girls with babies that are older than 3 or 4 years. Do the math.
