Political Asylum for Thaksin?

So the news is that Toxin and his convict wife have fled Thai Justice, just when it seemed that some REAL justice was about to be handed out.

And the rumour is that Thaksin will claim political asylum in UK...

My thought is, "How can you claim political asylum from a government you hand picked and paid for?"

I'm not very open minded on the Thaksin issue - I think the guy is a despicable thief and liar and an embarrassment to Thailand.

How about the rest of TF?

Damn, I remember banning Belle when she was 15 or so.... and again when she made her various attempts to get back in.... Looks like we failed to stop her...

I have questions...

1. Why England? Why England let the criminals leave in their country? never feel bad? Actually, a criminal, Pinn Jukraphap, still in England, never return. So, England is good place for the criminals?

2. What if England send Thaksin and his wife back... which jail is strong enough to put them in?

Why England?

Well bcool it goes little bit like that.

1. If you are rich you can get an asylum annywhere and as far as I know Takshin is rich.

Yeah he rich, rich enough? I heard that he borrow money from the ex owner of Man City, to pay for staff, right? :roll:

2. If run from a country A to country B. And if country B (democratic country) thinks that country A has some problems with democracy and that you run away because you are being harrased at your country and that allegations against you are politically motivated, well then it might happens that country B grant you an asylum. Oh did I mention that It helps if you are rich and well known.

If that poor Thaksin... but if you see, the Gov. is his nominee... so what he afraid of? If he insist that he isn't guilty so prove it.

From what I see... he is being here Thailand to mess around. Destroy culture system... life style... I didn't say modern isn't good, but if he just do in the proper way.

It is an exchange program....criminals wanted in the UK come to Thailand and elite Thais fleeing justice go to London!

Well firstly, he has not been convicted on any criminal offence yet so it may be premature to give him that label. Ok it would be different for Khunying Potjaman if she does not appear for the appeal hearing or breaches the conditions of her bail.

Failing to appear for court and having an arrest warrant issued does not mean that another country is obliged to deport someone unless Thailand seeks his extradition. An extradition process would take some time on both sides, probably years, given the asumed prolonged preparation of an application by Thailand under a PPP govt. and then, exhausting of all judicial appeal rights in the UK by Thaksin.

However, at the end of the day the UK is a poor option in the medium & long term for someone evading justice in Thailand, as the UK has something called Rule of Law and Due Process and the authorities take their politically, independent mandates professionally. More likely at some stage another country that either has no extradition treaty with Thailand or where the criminal justice authorities can be bought to ignore any extradition proceedings will be a safer bet for the Thaksins.

But to answer your query, yes England is a good place for rich 'criminals' to hang out as due to the great shopping opportunities and social life that one can partake in.

The whole asylum spin language being used by the Thaksin people is really offensive to the integrity of those in genuine need of asylum.

I have another question, how can the UK allow this and call themselves a friend of Thailand? I think if it was you or me, we would be arrested and sent back.

The British government is a piece of sh_t to allow this.....

What has the British govt allowed actually? Has an asylum application been lodged? Very doubtful....even if one has been lodged the UK govt has to accord due process to the application and there are proscribed time periods for the application to be processed. (Entering on a diplomatic passport and claiming asylum would make any application particulary unique).

No, I think all that has occured is that a family of Thais has entered the UK on some sort of innocuous normal visa. And if Thaksin is using his diplomatic passport there really is less scope for UK immigration to block entry unless Thailand revokes the passport.

We have to wait and see what happens if the Thai authorities seek extradition.........which already seems to be underway.

This will ultimately be a contest between those PPP pollies who wish to 'pardon' Thaksin and the judicial authorities hopefully doing their job to ensure he answers to the allegations amde against him and complies with courts orders.

Authorities have moved to seize the assets, revoke the diplomatic passports and seek the extradition of former prime minister Thaksin Shinawatra and his wife, Khunying Potjaman, who have skipped bail and fled to London. The Office of the Attorney-General (OAG) has set up a team to seek the extradition of Mr Thaksin and his wife.

The OAG is also expected to apply for a court order next week for the seizure of the Shinawatra family's assets, worth about 76 billion baht _ mostly now frozen at local banks. Deputy Attorney-General Chullasingh Wasantasingh is likely to head the extradition team, said Kosolwat Inthuchanyong, an OAG assistant spokesman. The application would be made under the terms of the 1911 Siam-Great Britain extradition treaty.

He said the process should not take long because the possibility of seeking the couple's extradition had been examined in depth before they returned to Thailand early this year. Mr Kosolwat said the authority to seek their extradition rests with the OAG because the couple fled while being tried in court. ''But if Mr Thaksin seeks asylum in Britain it will complicate matters,'' Mr Kosolwat said.

In a hand-written statement faxed to media outlets, the ousted prime minister claimed he fled overseas because the justice system in Thailand was being meddled with and he might not receive a fair trial. Deputy Attorney-General Waiyawut Lortrakul, head of the prosecution team in charge of the Assets Scrutiny Committee's cases, said the prosecution had finished drafting the civil suit seeking to confiscate Mr Thaksin's assets. He expected the case to be lodged with the Supreme Court's Criminal Division for Holders of Political Positions next week.

Mr Waiyawut said the decision to seize the assets was made at a meeting of prosecutors and the National Counter Corruption Commission, which has taken over cases from the now-defunct Assets Scrutiny Committee (ASC). Before the handover, the ASC charged that Mr Thaksin had dishonestly accumulated wealth while in office.

The ASC, which was disbanded in June, had already frozen assets worth 69 billion baht held by Mr Thaksin and his family members in 16 bank accounts. Foreign Minister Tej Bunnag said yesterday the ministry will make it a priority if there is a request by the court or the prosecution to revoke Mr Thaksin's diplomatic passport.

So far, the ministry had not received a request or documents relating to warrants for the arrest of Mr Thaksin and his wife, he said. ''The ministry will look into criteria for granting or revoking diplomatic passports when there is a chance to ensure that it properly observes the law as well as the ministry's directives,'' he said. Mr Tej said the ministry will consider what actions to take over the extradition process when it has been properly informed of the situation and legal procedures.

Sitthichoke Sricharoen, head of a legal team representing the ASC, said the couple's escape reflects their intention not to fight the charges. However, they can still defend themselves by submitting their testimony in writing. He also underlined that the charges against the couple are not political, but criminal.

Dej-udom Krairit, chairman of the Lawyers Council of Thailand, yesterday lambasted Mr Thaksin for attacking the judiciary in his fax. Mr Thaksin claimed the legal procedures against him were like the fruit of poisonous trees and his cases prejudged. According to Mr Dej-udom, Mr Thaksin was the poison. He also urged police to post warrants for the couple's arrests at every port, airport and border checkpoint.
